NO PURCHASE OR SALES PRESENTATION ATTENDANCE NECESSARY TO PARTICIPATE. A PURCHASE OR PAYMENT OF ANY KIND OR SALES PRESENTATION ATTENDANCE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE PURPOSE OF THIS SWEEPSTAKES IS TO SOLICIT THE SALE OF TIMESHARE INTERESTS BY HILTON GRAND VACATION COMPANY, LLC. ANY PERSON WHOSE NAME OR ADDRESS IS OBTAINED AS A RESULT OF THIS SWEEPSTAKES MAY BE SOLICITED TO PURCHASE A TIMESHARE INTEREST IN COMPLIANCE WITH APPLICABLE LAW. VOID OUTSIDE THE 50 UNITED STATES, DISTRICT OF COLUMBIA, JAPAN AND WHERE PROHIBITED BY LAW.
1. ENTRY: To enter the Hilton Grand Vacations 2009 Grand Giveaway (“Sweepstakes”) online, go to www.hgvcsweeps.com and follow the on-screen instructions for completing the online entry form and entering the Sweepstakes. Online entry begins at 12:01 AM Central Standard Time (“CST”) on February 1, 2009 and ends online at 11:59PM (CST) on January 31, 2010 (“Promotion Period”). To enter at select Hilton Grand Vacations Club locations or select Hilton Grand Vacations Marketing locations in Nevada; Hawaii; and Florida complete the official entry form and deposit it in the entry box provided. Entries must be deposited by 11:59PM (CT) January 31, 2010. You may also enter the drawing by hand-printing your name, complete home address, home telephone number with area code, and date of birth on a 3” x 5” white card and mailing it (or official entry form) in a postage-paid hand-addressed #10 envelope (one entry per envelope) to “Hilton Grand Vacations 2009 Grand Giveaway” at P.O. Box 8525 Prospect Heights, IL 60070. Mailed entries must be postmarked by January 31, 2010, and received by February 8, 2010. No computer generated or mechanically reproduced entries will be accepted. Entries using macro, script or other forms of automatic entry will be disqualified. Sponsor is not responsible for lost, late misdirected, incomplete, inaccurate or mutilated entries. Entries become property of Hilton Grand Vacations Company, LLC (“Sponsor”) and will not be returned. Limit one (1) entry per person or household regardless of method of entry during the Promotion Period.
2. DRAWING: Winners will be selected in a random drawing from all eligible entries received. Drawing will be held on or about March 1, 2010 by Promotion Activators, Inc., an independent judging organization, whose decisions shall be final on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received.
3. PRIZES: A total of four prizes may be awarded.
ONE (1) GRAND PRIZE: 2010 Cadillac Escalade Hybrid RWD or equivalent model, including destination and handling and dealer fees. Approximate retail value (“ARV”): USD $75,000. Interior and Exterior color, features and all options, including warranty selection of vehicle, are at the sole discretion of Sponsor. Vehicle will be delivered through a dealer of Sponsor’s choice in the winner’s residential area. Prize vehicle may change due to model changes, availability, or other circumstances. Prospective winner must possess a current, valid, driver’s license and must present such license and proof of valid car insurance by the deadline specified by Sponsor, in order to take possession of the vehicle. All other costs related to prize acceptance and use are the responsibility of winner, including but not limited to sales taxes, title, insurance, license, and registration fees. Winner may choose to receive a cash alternative prize of USD $75,000. In the event the winner elects to take the cash equivalent in lieu of the automobile, the winner will be required to sign an agreement acknowledging and accepting the cash equivalent.
ONE (1) FIRST PRIZE: One (1) Trip to for two (2) to Waikoloa, Hawaii for a consecutive five (5) night stay in a one bedroom unit at the Hilton Grand Vacations Club at Waikoloa Beach Resort, including two (2) airfare vouchers with a maximum value up to $1000 each for travel from the nearest major U.S. or Japan Gateway airport nearest to winner’s primary residence within the US or Japan to the Kona airport, plus a $1,000 American Express Gift Card. ARV: $6,145. Winner may choose to receive a cash alternative prize of USD $6,100. In the event the winner elects to take the cash equivalent in lieu of the trip, the winner will be required to sign an agreement acknowledging and accepting the cash equivalent.
ONE (1) SECOND PRIZE. One (1) Trip for two (2) to Las Vegas, Nevada for a consecutive five (5) night stay in a one bedroom unit a the Hilton Grand Vacations Club on the Las Vegas Strip, including two (2) airfare vouchers with a maximum value up to $1,000 each for travel from the nearest major U.S. or Japan Gateway airport nearest to the winner’s primary residence within the U.S. or Japan to the Las Vegas McCarren International Airport, Las Vegas, Nevada, plus a $1,000 American Express Gift Card. Approximate retail value: USD $4,445. Winner may choose to receive a cash alternative prize of USD $4,400. In the event the winner elects to take the cash equivalent in lieu of the trip, the winner will be required to sign an agreement acknowledging and accepting the cash equivalent.
ONE (1) THIRD PRIZE. One (1) Trip for two(2) to Orlando, Florida for a consecutive five (5) night stay in a one bedroom unit at the Hilton Grand Vacations Club on International Drive, including two (2) airfare vouchers with a maximum value up to $1,000 each for travel from the nearest major U.S. or Japan Gateway airport nearest to winner’s primary residence within the U.S. or Japan to the Orlando International Airport, Orlando, Florida, plus a $1,000 American Express Gift Card. Approximate retail value: USD $4,395. Winner may choose to receive a cash alternative prize of USD $4,300. In the event the winner elects to take the cash equivalent in lieu of the trip, the winner will be required to sign an agreement acknowledging and accepting the cash equivalent.
Sponsor makes no guarantee or representation that the airfare vouchers will be sufficient to pay for air transportation for winner and winner’s traveling companion. Any additional expenses related to airfare are the winner and their traveling companion’s sole responsibility.
Total ARV of all prizes is USD $89,985. American Express Gift Card may be used at participating retailers worldwide at no charge for one year from date of issuance. After one year, a $2.00 monthly service charge may be deducted from the value of the gift card. Trip and travel insurance is not included. Blackout dates and any other applicable travel restrictions may apply. Travel arrangements, including redemption of airfare voucher, must be made through Sponsor or Sponsor’s designated agent on a carrier of Sponsor’s choice. No cash value or redemption for unused airfare vouchers or portions thereof. Airfare voucher not valid with any other offer, discount or promotion. If winner resides less than 150 miles from destination, air travel vouchers will not be awarded and no additional compensation will be provided. Accommodations and airfare are subject to availability, must be reserved at least ninety (90) days in advance of the departure date, and stays and travel must be completed within 18 months of award. No extension of trip dates will be permitted, except at Sponsor’s sole discretion. If winner is unable to complete trip within the dates specified herein, the winner shall forfeit the prize in its entirety. Prize winner and his/her guests must travel together on the same itinerary. Guest must be the age of majority in his/her state of residence unless accompanied by a parent or legal guardian, who must be the winner, and must sign and return a liability/publicity release prior to ticketing. Parent or guardian of any minor companion must sign and return such release.
No substitution, transfer or cash redemption of prize is permitted, except as expressly set forth herein by Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value (at its sole discretion). Selected winners will be solely responsible for obtaining and complying with applicable port of entry requirements and related costs, if any. Any expenses not specifically stated herein, including but not limited to state and local government surcharges, and all taxes (sales, income (federal, state and local), airport, value-added and other), gratuities, licenses, incidental expenses, ground transportation, meals, registrations, port charges, telephone calls, fees or charges for changing dates, travel insurance premiums, and other costs and other expenses relating to Sweepstakes and use or acceptance of a prize is the sole responsibility of the winner and the winner’s guest.
4. ELIGIBILITY: Sweepstakes open to legal residents of the 50 United States, District of Columbia and Japan who are of majority age in their location of residence at the time of entry. Employees of the Sponsor, its parent company, affiliates, subsidiaries, agents, retailers, advertising, promotion, and judging agencies and members of the immediate families or household members of any of the above are NOT eligible to participate. For purposes of these rules, “immediate families” means parents, step parents or legal guardians, siblings, step-siblings, children and step-children, regardless of where they reside. “Household members” shall mean people who share the same residence at least three (3) months a year, whether related or not.
5. GENERAL: All federal, state and/or other income taxes are the winners’ sole responsibility. Winners will be notified by phone, email or postal mail, at Sponsor’s discretion and will be required to execute and return any affidavits of eligibility and liability/publicity releases (where permitted) by prepaid overnight delivery within ten (10) calendar days of notification (first attempted delivery). First, Second, and Third Prize winner’s guests (or their parent/legal guardian if they are considered minors in their state/country of residence) will also have to complete a liability and publicity release within the same time stated above. Failure of a prospective winner to comply with the above prize claim requirements for any reason, any of these Official Rules, or the return of any prize notification or prize as undeliverable, or the determination that any winner is ineligible to receive a prize, will result in forfeiture of the corresponding prize. If the prize is forfeited for any reason, an alternate winner may be drawn at random from the remaining eligible entries and awarded the prize. Sponsor reserves the right to substitute a prize of equal or greater value should the featured prize not be available for any reason. Sponsor assumes no responsibility for lost, late, damaged, mutilated, misdirected, incomplete or illegible entries; all such entries will be disqualified. In the event of a dispute as to the identity of an online entrant, online entries will be deemed made by the authorized account holder of the e-mail addressed submitted at time of entry. The authorized account holder is the natural person assigned to the e-mail address by an internet access provider, online service provider, or other organization responsible for assigning e-mail addresses. Prize must be accepted as awarded. Except where prohibited by law, acceptance of any prize constitutes permission to use a winner's name, hometown, likeness, photograph, statements made by the winner about the promotion and/or prize information for advertising and publicity purposes in all media worldwide without limitation and without additional compensation. By participating, participants agree to abide by and be bound by these official rules and the judges’ decisions, which are final in all matters relating to this Sweepstakes and understand that Sponsor intends to use all such information provided to it for the purpose of soliciting the sale of timeshare interests (subject to applicable law). By accepting a prize and entering this Sweepstakes, entrant agrees to release Sponsor, its parent company, affiliates, subsidiaries, directors, officers, employees, and agents, including but not limited to Promotion Activators, Inc., from any and all liability for any injuries, losses, or damages of any kind resulting from or in connection with accessing the Sweepstakes web site, submitting any entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use or misuse of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity. Sponsor is not responsible for typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize. Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the online entry portion of the Sweepstakes, should a virus, bug, tampering or other causes beyond the control of the Sponsor corrupt the administration, security or proper operation of the Sweepstakes. In the event that the online entry portion of the Sweepstakes is cancelled during the Promotion Period, prizes will be awarded from among all eligible, non-suspect, online entries received as of the time/date that the online entry portion of the Sweepstakes was terminated combined with all off-line eligible entries received throughout the stated entry period. Sponsor assumes no responsibility or liability for any incorrect or inaccurate entry information, or for any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes. Sponsor and its agencies are not responsible for computer system, electronic transmission, phone line, hardware, software, or program malfunctions, or other errors, failures or delays in computer transmissions or network connections or Sweepstakes play that are human or technical in nature. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or falsifying entry or verification information. Any individual’s use of robotic, automatic, programmed or similar entry methods will void all entries by that individual. Sponsor reserves the right to disqualify entrants who violate any of the official rules, or attempt to interfere with the promotion in any manner. Any attempt by an entrant to deliberately damage the web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including but not limited to attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution. Information gathered through this promotion may be used for vacation ownership marketing purposes by the Sponsor.
6. GOVERNING LAW. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of California, without regard to conflicts of law. All suits or claims brought in connection with this Sweepstakes must be brought in a state or federal court in Los Angeles, California.
